TERMS AND CONDITIONS

This is an agreement between NationalWay Healthcare Association and you, the memer, to verify your understanding of all membership conditions. Please, carefully read all of the terms and conditions before using this site. Use of this site provides your consent to all terms and conditions contained herein.

1. Membership
-Member shall be the person whose name appears on the enrollment form or is the spouse of the person whose name appears on the enrollment form.
- User shall be the person whose name appears on the enrollment form or shall have a current and valid written authorization from the person whose name appears on the enrollment from authorizing User to obtain information from the enrollment form for the purpose of maintaining or upgrading membership, verifying benefits or other purposes related to the dissemination of personal information as granted by Member.

2. Disclaimer
- NationalWay Healthcare Association is not responsible for any errors or ommissions in the information collected while registering for membership from user or mechanical error as well as other factors beyond normal control.
- Member shall be responsible for verifying the validity of all information submitted to NationalWay Healthcare Association on the enrollment form.

3. Use of Information
- User, for itself or on behalf of Member, authorizes NationalWay Healthcare Association to obtain information from the enrollment form for the purposes of providing membership. Upon completion and submission of the enrollment form NWHA may verify the completeness and accuracy of the information and the NationalWay Healthcare Association will retain the submitted enrollment form for archival purposes but will not make this available to outside organizations or person's without Member or User consent.
- Member agrees to allow NationalWay Healthcare Association to share Member's personal information with benefit providers for the sole purpose of providing agreed upon membership benefits as outlined for Member's chosen membership level.
- NationalWay Healthcare Association agrees to protect the privacy of member's information and will only share information with parties associated with providing Association member services including, but not limited to, Third Party Administrator billing, health and lifestyle benefit provisions, member services, etc.
- Nationalway Healthcare Assocation will not sell Member information to any party for any marketing purpose and will only distribute information based upon benefit fulfillment or Member permission.

4. Billing
- Upon submission of enrollment form to NationalWay Healthcare Association with applicable fees, if any, User shall take no action that interferes with the ability of NationalWay Healthcare Association to collect said fees. User agrees that all fees are nonrefundable unless so stated by membership. Most memberships carry a 30 day Refund Policy as outlined in the Member Information Guidebook as well as a nonrefundable enrollment fee.
- All billing information collected by NationalWay Healthcare Association is for the sole purpose of providing membership and associated benefits to Member and at not time will billing information be shared with any party other than NWHA's designated Third Party Administrator for the purposes of collecting only those Dues and Fees agreed upon by User.
- Upon completion and confirmation of this enrollment User agrees to have applicable NationalWay Healthcare Association dues and Enrollment Fees deducted from their chosen account by ACH debit. The bank account will be debited automatically each month for Membership Dues associated with Member's chosen membership level. User may terminate membership at any time by contacting Member Services as outlined in the Member Information Guidebook. Upon termination the bank account designated by User will not be drafted thereafter.

5. Denial of Future Service
- User agrees NationalWay Healthcare Association may deny Member access to services with regard to future transactions in the event User or Member breaches the terms of this agreement without refund of Dues and/or Fees collected.

6. Entire Agreement
- This agreement supersedes all other agreements either oral or written between User and NationalWay Healthcare Association regarding the membership. No waiver, alteration or modification of provisions in this agreement shall be binding unless subsequently made in writing and signed by duly authorized representatives of NationalWay Healthcare Association.
- By completing the enrollment form, Member agrees to all Terms and Conditions contained herein. Member agrees all information provided is true and accurate to the best of their knowledge. Member understands any false information intentionally provide by User for the purpose of obtaining benefits or memberhsip constitutes a breach of these Terms and may result in membership termination and/or the denial of provided member benefits without refund of any Dues or Fees collected.

7. Acceptance of Terms
Nationalway provides its Services to you, subject to the following Terms of Use (TOU), which may be updated by Nationalway at any time without notice to users. In addition, when using particular Nationalway Services, you and Nationalway shall be subject to any posted guidelines or rules applicable to such Services. All such guidelines or rules are hereby incorporated by reference into the TOU. This agreement is to be construed and interpreted according to the laws of the State of Arizona. The failure of Nationalway to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision.

8. Description of Services
Nationalway currently provides users with access to a variety of Services, including but not limited to, various communications tools, email-based discussion groups, forums, job banks, staffing services, free email, source code, documents, news, press releases, peer publishing, industry articles, and knowledge banks. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new Nationalway Knowledge Bases, shall be subject to the TOU. You understand and agree that the Service is provided "AS-IS" and that Nationalway assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or user preference settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.
